Bonding and Registration

How Do I Bond and Register my Promotion? Where is it Required?

State-by-state regulations may require your promotion to be bonded and registered with the local, regulating bodies.

Several states have their own requirements for where and when this is required including:

  • The total approximate retail value (ARV) of the prizes
  • Promotion type (game of chance vs. game of skill) and winner selection method
  • “Open to the Public” or “Closed Audience” promotions
  • Retail store presence in state
  • And more…

Bonding and Registration requirements state that the promotions must be registered at a defined lead time prior to your promotion’s launch, and where necessary, surety bonds guaranteeing delivery of the prizes offers must be purchased. After the promotion ends, the sponsor (or their agent, such as Realtime Media) must report the winners to each state in which the promotion was registered and release the bonds.

Failure to properly complete all bonding and registration steps may result in fines and penalties from state entities.

At Realtime Media, our expert legal team can advise on when and where bonding and registration may be required for your promotion as well as handle the necessary precautions and paperwork required to ensure your promotion is compliant within those states. We can also handle all steps of the bonding and registration process for you, freeing you up for other activities.
